TRIGGER service s.r.o. will process your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons concerning the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) – hereinafter referred to as the “Regulation.”

TRIGGER service s.r.o. will process your personal data provided to it in the following scope:

Identification data (name, surname, date of birth, company ID, VAT number)

Contact data (email, address, phone number)

Information about purchasing habits

IP address

 

TRIGGER service s.r.o. will process your personal data for the purpose of fulfilling the contractual obligation to provide you with the goods and services you decided to purchase on our web portal www.triggerservice.cz.

If you grant consent for the sending of commercial communications, TRIGGER service s.r.o. will also process your personal data for the purpose of sending commercial communications informing you about the goods and services of TRIGGER service s.r.o. and its business partners. You have the right to withdraw this consent at any time.

Furthermore, we would like to inform you that the processing of personal data for direct marketing purposes can be considered processing based on the legitimate interest of the controller. Therefore, TRIGGER service s.r.o. is entitled to send you, even without your consent, offers of similar goods and services you have previously purchased from us, to the email address you have provided. You may refuse the sending of these offers at any time. Each customer has the opportunity to freely refuse further offers in every individual communication by clicking the appropriate explicit link in the offer. Your personal data will not be shared with any third parties except for third parties through which we ensure the delivery and fulfillment of the goods and services you purchase from us.

These primarily include delivery companies if you choose to have your goods delivered by one of these third parties. In such cases, your personal data will be shared with the selected delivery company to the minimum extent necessary to fulfill the contract – that is, to deliver the goods.

The recipient of your personal data in such cases will, depending on your choice, be the courier company:

Additionally, your personal data will be passed to individual suppliers through whom we ensure the realization of the individual experiences, again only to the minimum extent necessary to fulfill the contract.

Finally, your personal data will be shared with IT specialists responsible for the operation of our web portal www.triggerservice.cz.

Your personal data will be processed for a period of three years from the date you purchase our goods or services.

In relation to the processing of your personal data by TRIGGER service s.r.o., we would also like to inform you about your following rights:

1. The right to request access to your personal data, meaning your right to obtain, upon request from TRIGGER service s.r.o., information (confirmation) on whether your personal data are being processed. If your personal data are being processed, you have the right to access such data and to obtain the following information:

a) the purposes of the processing;

b) the categories of personal data concerned;

c) the recipients or categories of recipients to whom your personal data have been or will be disclosed, in particular recipients in third countries or international organizations;

d) the envisaged period for which your personal data will be stored, or, if not possible, the criteria used to determine that period;

e) the existence of the right to request from TRIGGER service s.r.o. rectification or erasure of personal data or restriction of processing concerning you or to object to such processing;

g) all available information about the source of the data, if they were not obtained directly from you;

h) the existence of automated decision-making, including profiling referred to in Article 22(1) and (4) of the Regulation, and meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for you.

2. The right to request rectification of your personal data, meaning the right to have TRIGGER service s.r.o. correct inaccurate personal data concerning you without undue delay. You also have the right to have incomplete personal data completed, including by means of providing a supplementary statement.

3. The right to request erasure of your personal data, meaning the right to have TRIGGER service s.r.o. erase personal data concerning you without undue delay if one of the following grounds applies:

a) your personal data are no longer necessary for the purposes for which they were collected or otherwise processed;

b) you withdraw the consent on which the processing is based, and there is no other legal ground for the processing;

c) you object to the processing under Article 21(1) of the Regulation and there are no overriding legitimate grounds for the processing;

d) your personal data have been unlawfully processed;

e) your personal data must be erased for compliance with a legal obligation under Union or Member State law to which TRIGGER service s.r.o. is subject;

f) your personal data were collected in relation to the offer of information society services under Article 8(1) of the Regulation.

4. The right to restrict processing, meaning the right to have TRIGGER service s.r.o. restrict the processing of your personal data if:

a) you contest the accuracy of your personal data, for a period enabling TRIGGER service s.r.o. to verify the accuracy of the personal data;

b) the processing is unlawful and you oppose the erasure of the personal data and request the restriction of their use instead;

c) TRIGGER service s.r.o. no longer needs the personal data for the purposes of the processing, but you require them for the establishment, exercise, or defense of legal claims;

d) you have objected to processing pursuant to Article 21(1) of the Regulation pending verification whether the legitimate grounds of TRIGGER service s.r.o. override yours.

5. The right to data portability, meaning the right to obtain the personal data concerning you, which you have provided to TRIGGER service s.r.o., in a structured, commonly used, and machine-readable format, and the right to transmit those data to another controller without hindrance from TRIGGER service s.r.o., provided that:

a) the processing is based on consent pursuant to Article 6(1)(a) of the Regulation or Article 9(2)(a) of the Regulation or on a contract pursuant to Article 6(1)(b) of the Regulation; and

b) the processing is carried out by automated means.

When exercising your right to data portability, you have the right to have the personal data transmitted directly from TRIGGER service s.r.o. to another controller, where technically feasible.

6. The right to object, meaning the right to object, on grounds relating to your particular situation, at any time to the processing of personal data concerning you, based on:

• processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller; or

• processing necessary for the purposes of the legitimate interests pursued by the controller or a third party.

If you object to the processing of your personal data, TRIGGER service s.r.o. will no longer process the personal data unless it demonstrates compelling legitimate grounds for the processing which override your interests, rights, and freedoms, or for the establishment, exercise, or defense of legal claims.

You can also object to the processing of personal data for direct marketing purposes or profiling. If you object to processing for direct marketing purposes, your personal data will no longer be processed for such purposes.
